What kind of customer information do we have, and where did we get it?

Much of the customer information we collect comes directly from you. When submitting your application or request for insurance or other products and services we offer, or in requesting an insurance quote, you may give us information such as your name, address, and Social Security number. We also keep information about your transactions with our affiliates, others, or us – for example, the types of products and services you purchase from us, premiums, policy account balances and payment history. We also may collect information from outside sources, including consumer reporting agencies and/or health care providers or reporting agencies such as the Medical Information Bureau (MIB). This information includes loss information reports, motor vehicle reports, credit reports, and medical information.

Who collects this information?

In order to better serve your particular needs, the information noted above is collected by Southern Elite Insurance Group, its agents, and other companies working on behalf of Southern Elite Insurance Group. In addition to collecting information from you, you should also know that, depending on the nature of your transaction, we may collect information from outside sources, such as loss information reports, motor vehicle reports, and credit reports. For property insurance, we may send someone to inspect your property and verify information about the value and condition of your property.

Who has access to this information?

In order to better serve your particular needs, our company, its employees, and certain companies working on our behalf have access to this information. This information may also be disclosed to third parties without your consent if disclosure is necessary to comply with legal processes or to protect the rights, property, or personal safety of Southern Elite Insurance Group, its users or the public. We may also provide limited information about you to third parties without your permission when necessary or appropriate to service an insurance policy we have issued (e.g., inquiries from lien holders or additional insureds listed on the policy) or to address claims submitted under a policy we have issued. In addition, we may, as permitted by law, provide information about you without your permission to certain persons or organizations, such as: your agent or broker; insurance support organizations; other insurance companies in order to perform their function in regard to an insurance transaction involving you (i.e. a claim); independent claim adjusters; businesses that conduct actuarial or research studies; regulatory and law enforcement authorities; or our affiliated companies, if any.

Personal, Financial and Product Information: 

We collect personally identifiable information in order to identify and register you as a customer. In addition, we collect personal, financial and product information in order to provide you with services for your particular needs. By learning about you, we can deliver more relevant protection and product offerings and thus offer you better insurance services and options. The information we collect will vary depending upon the function or processes you select or request. Depending upon the function, product or process you select (for example, quote, request for proposal, e-mail, purchase), you may be required to provide information such as:

Personal Information:

  • Contact Information: Name, email address, phone number, mailing address.
  • Account Information: Policy(ies) Type(s) & Number(s), and other information you provide when creating an account.
  • Identifiable Information: Birthdate, Social Security Number, Driver’s License Number, accident/violation history, information about vehicle operators, lien/lease holders, vehicle information, etc.
  • Payment Information: Credit card details, billing information (if applicable).

Non-Personal Information:

  • Cookies and Tracking Data: IP address, browser type, device type, operating system, and other usage data.
  • Usage Data: Information about how you interact with the Site, including pages visited, links clicked, and other user behavior.

We may collect this information through forms, cookies, analytics tools, or other methods of tracking user interactions.

2. How We Use Your Information

9. Children’s Privacy

Our Site is for insurance and financial products and services and is not intended for children under the age of 18. We offer insurance and financial products and services and thus do not market any products or services to children under the age of 18 or knowingly collect any information from children under the age of 18. If we become aware that information is or has been submitted by or collected from a child under the age of eighteen, we will destroy this information.

This California Privacy Notice (“California Notice”) supplements the information contained in our General Privacy Policy above and applies solely to consumers who reside in the State of California (“consumers” or “you”). We provide this California Notice to comply with the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (collectively, the “CCPA”), and other California privacy laws. Any terms defined in the CCPA have the same meaning when used in this California Notice. In the event of any conflict between this California Notice and any other portion of our Privacy Policy, this California Notice controls with respect to California residents.

Scope and Exemptions. Certain personal information we collect, process, or disclose in connection with insurance and financial products and services may be subject to, and exempted from the CCPA by, other privacy laws, including the Gramm-Leach-Bliley Act (GLBA), the California Financial Information Privacy Act, the California Insurance Information and Privacy Protection Act, the Fair Credit Reporting Act (FCRA), and the Health Insurance Portability and Accountability Act (HIPAA). To the extent information is regulated by those laws, the notices and rights described in those laws apply and this California Notice does not.

1. Categories of Personal Information We Collect

We collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device (“personal information”). Within the twelve (12) months preceding the effective date of this California Notice, and on an ongoing basis, we have collected the following statutory categories of personal information:

  • A. Identifiers. Such as a real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol (IP) address, email address, account name, Social Security number, driver’s license number, or other similar identifiers.
  • B. Personal records (Cal. Civ. Code § 1798.80(e)). Such as name, signature, Social Security number, physical characteristics or description, address, telephone number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial, medical, or health insurance information. Some personal information in this category may overlap with other categories.
  • C. Protected classification characteristics. Such as age, marital status, sex, and, where relevant to underwriting or claims, other characteristics protected under California or federal law.
  • D. Commercial information. Such as records of products or services purchased, obtained, or considered, policies held, premiums, claims and payment history, and other purchasing or consuming histories or tendencies.
  • E. Internet or other similar network activity. Such as browsing history, search history, and information regarding your interaction with our Site, applications, or advertisements.
  • F. Geolocation data. Such as general location derived from your IP address or, where applicable to a product, information about an insured property or vehicle.
  • G. Sensory data. Such as audio recordings of customer service or phone calls where permitted by law.
  • H. Professional or employment-related information. Such as occupation and employer, where relevant to a quote, application, or claim.
  • I. Inferences. Such as inferences drawn from any of the information identified above to create a profile reflecting preferences, characteristics, or risk.
  • J. Sensitive personal information. Described separately in the section below.

We do not knowingly collect biometric information or education information subject to the Family Educational Rights and Privacy Act (FERPA) through the Site.

2. Sensitive Personal Information

We may collect the following categories of sensitive personal information: government identifiers such as a Social Security number, driver’s license number, or state identification card number; account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account; precise geolocation; and, where relevant to a product, application, or claim, information concerning health. We collect and use sensitive personal information only for the purposes permitted by the CCPA, such as performing services reasonably expected by the consumer (for example, providing a quote, underwriting, or servicing a policy or claim), and we do not use or disclose sensitive personal information for purposes of inferring characteristics about a consumer. Because our use is limited to these permitted purposes, we are not required to offer, and do not offer, a right to limit the use of sensitive personal information beyond these purposes. We do not sell or share sensitive personal information.

3. Sources of Personal Information

We obtain the categories of personal information listed above from the following categories of sources: directly from you (for example, through forms, quote and application requests, and communications); automatically from your device and browser as you use our Site (for example, through cookies and analytics tools); from your insurance agent or broker; from our affiliates and companies working on our behalf; and from third parties such as consumer reporting agencies, insurance support organizations, the Medical Information Bureau, motor vehicle and loss-history reporting services, and other insurers.

4. Purposes for Collecting and Using Personal Information

We collect and use personal information for the business and commercial purposes described in our General Privacy Policy, including to: provide insurance quotes, applications, underwriting, policy servicing, and claims handling; verify your identity and prevent fraud; process transactions and payments; respond to your inquiries and requests; personalize, maintain, secure, and improve our Site and services; perform actuarial or research studies; communicate with you, including marketing where permitted; and comply with legal, regulatory, and contractual obligations.

5. Disclosure of Personal Information

Within the preceding twelve (12) months, we may have disclosed each of the categories of personal information listed above for one or more business purposes to the following categories of third parties: our affiliates; your agent or broker; service providers and contractors that perform services on our behalf (such as hosting, analytics, payment processing, and communications providers); insurers, reinsurers, and insurance support organizations; consumer reporting agencies; professional advisors such as attorneys, auditors, and accountants; and government agencies, regulators, and law enforcement as required or permitted by law.

6. Sale or Sharing of Personal Information

We do not sell your personal information, and we do not share your personal information for cross-context behavioral advertising, as those terms are defined under the CCPA. We have not sold or shared the personal information of consumers, including consumers under 16 years of age, in the preceding twelve (12) months. Because we do not sell or share personal information, we are not required to provide, and do not provide, a “Do Not Sell or Share My Personal Information” link; however, you may still contact us at any time with questions about our data practices.

7. Retention of Personal Information

We retain each category of personal information for as long as reasonably necessary to fulfill the purposes for which it was collected, including to provide our products and services, maintain business and financial records, and comply with our legal, regulatory, tax, accounting, and recordkeeping obligations, resolve disputes, and enforce our agreements. When personal information is no longer needed, we take reasonable steps to securely delete, destroy, or de-identify it.

8. Your California Privacy Rights

Subject to certain exceptions and verification requirements, California residents have the following rights under the CCPA:

  • Right to Know / Access. You have the right to request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources from which it was collected, the business or commercial purpose for collecting it, the categories of third parties to whom we disclose it, and the categories of personal information we have disclosed for a business purpose. Your request is not limited to the twelve (12) months preceding your request; where we retain personal information for longer than twelve months, we will provide information collected beyond that period on request, except for personal information collected before January 1, 2022.
  • Right to Delete. You have the right to request that we delete personal information we have collected from you, subject to certain exceptions (for example, where the information is necessary to complete a transaction, provide a service you requested, comply with a legal obligation, or is otherwise permitted to be retained by law).
  • Right to Correct. You have the right to request that we correct inaccurate personal information we maintain about you, taking into account the nature of the information and the purposes of processing.
  • Right to Opt-Out of Sale or Sharing. You have the right to opt out of the sale of your personal information and the sharing of your personal information for cross-context behavioral advertising. As stated above, we do not sell or share personal information.
  • Right to Limit Use of Sensitive Personal Information. You have the right to limit the use and disclosure of your sensitive personal information to certain permitted purposes. As stated above, we only use sensitive personal information for permitted purposes.
  • Right to Non-Discrimination. You have the right not to receive discriminatory treatment for exercising any of your CCPA rights. We will not deny you goods or services, charge you different prices, or provide you a different level or quality of goods or services because you exercised your rights.
  • Right to Data Portability. When responding to a Right to Know request, we will provide the information in a portable and, to the extent technically feasible, readily usable format that allows you to transmit it to another entity without hindrance.

9. How to Exercise Your Rights

To submit a Right to Know, Delete, or Correct request, you (or your authorized agent) may contact us using the contact information at the bottom of this notice, including by email at Send Email, by telephone, or by mail at our office address. Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a request on behalf of your minor child.

Verification. To protect your privacy and security, we will take reasonable steps to verify your identity before responding to your request. We may ask you to provide information that we can match against information already in our records to confirm your identity, and we may decline to process a request that we cannot verify. We will not fulfill your request unless you have provided sufficient information for us to reasonably verify that you are the person about whom we collected personal information, or an authorized representative.

Authorized Agents. You may designate an authorized agent to make a request on your behalf. We may require the authorized agent to provide proof that you gave them signed permission to submit the request, and may require you to verify your identity directly with us or confirm that you provided the agent permission to submit the request.

Response Timing. We endeavor to acknowledge receipt of a verifiable consumer request within ten (10) business days and to respond within forty-five (45) calendar days. If we require more time, we will inform you of the reason and extension period, up to a total of ninety (90) days, in writing. Any disclosures we provide will cover the period required by law. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded.

10. Notice of Financial Incentives

We do not offer financial incentives or price or service differences in exchange for the retention, sale, or sharing of your personal information.

11. Automated Decision-Making

We do not use your personal information to make solely automated decisions that produce legal or similarly significant effects concerning you without human involvement. If our practices change, we will update this California Notice and provide any notices and choices required by California law.

12. “Shine the Light” Disclosure

California’s “Shine the Light” law (Cal. Civ. Code § 1798.83) permits California residents to request certain information regarding our disclosure of personal information to third parties for their own direct marketing purposes. We do not disclose personal information to third parties for their direct marketing purposes. If you have questions, you may contact us using the information below.

13. Minors Under 16

We do not knowingly sell or share the personal information of consumers under 16 years of age. As stated in our General Privacy Policy, our Site is intended for an adult audience and we do not knowingly collect personal information from individuals under the age of 18.
